KUALA LUMPUR – In a clarion call that echoes across borders, Malaysia’s veteran human rights advocate, Waytha Moorthy Ponnusamy, has issued a blistering indictment of Prime Minister Anwar Ibrahim’s alleged manipulation of the judiciary.

Waytha, President of Parti Kemajuan Malaysia (MAP) and founder of the influential HINDRAF movement, has emerged as one of the strongest voices challenging what he calls “executive interference in the judiciary.” His statement, issued this week, raises grave constitutional, ethical, and institutional questions over the controversial elevation of Justice Wan Ahmad as Malaysia’s Chief Justice—an appointment he alleges is not only irregular but potentially unlawful.

“While the Prime Minister may have complied with the letter of the Federal Constitution, he has clearly violated its spirit,” Waytha declared. “No Prime Minister under active judicial scrutiny should hold sway over the very institution that might rule on his cases.”

The legal community and observers across Malaysia are now confronting an uncomfortable reality: that Malaysia, a key ASEAN democracy, may be spiraling toward a judicial crisis with far-reaching implications for human rights, rule of law, and public accountability.

Executive Interference or Constitutional Crisis?

According to Waytha, the Prime Minister failed to disclose critical information to the Conference of Rulers—Malaysia’s highest constitutional consultative body—regarding his ongoing legal entanglements, most notably the unresolved sexual misconduct allegations in the Yusoff Rawther case. The omission, Waytha argues, calls into question the very legitimacy of Anwar’s participation in judicial appointments.

Worse still, the process leading to Justice Wan Ahmad’s elevation is riddled with anomalies. Leaked minutes from the Judicial Appointments Commission (JAC), supported by a related police report, suggest that the Prime Minister’s Office may have exercised undue influence. Most notably, the promotion leapfrogged Wan Ahmad over 10 serving Federal Court judges and 22 more senior jurists, breaking with established Commonwealth conventions that prize seniority and impartiality.

“This is not merely a procedural irregularity,” Waytha said. “It is a dangerous precedent. When political loyalty overrides judicial merit, the very soul of our democracy is at stake.”

The statement also revealed that an earlier plan to fast-track Justice Terriyuddin to the top judicial post was dropped only after public uproar—indicating a pattern of calculated executive maneuvering, rather than transparent judicial governance.

A Track Record of Advocacy

Waytha Moorthy is no stranger to confrontation with state power. As the founder of HINDRAF, he led one of the largest civil rights movements in Malaysia’s history, championing the rights of marginalized ethnic Indian communities and confronting police brutality, custodial deaths, and systemic discrimination.

His activism led to international recognition, including support from UK-based legal circles and diaspora communities. He served briefly in government, only to resign when reforms failed to materialize. Today, as MAP’s president, he is again at the forefront—this time defending the very foundation of Malaysian justice.

His critics have called him controversial; his supporters hail him as Malaysia’s conscience. What is clear is that his latest intervention could catalyze national and global scrutiny. Legal community across Malaysia have appreciated him for raising valid questions regarding alleged appointment. However, sources believe, Prime Minister’s decision in this regards may not be changed now.
