Waytha, President of Parti Kemajuan Malaysia (MAP) and founder of the influential HINDRAF movement, has emerged as one of the strongest voices challenging what he calls “executive interference in the judiciary.” His statement, issued this week, raises grave constitutional, ethical, and institutional questions over the controversial elevation of Justice Wan Ahmad as Malaysia’s Chief Justice—an appointment he alleges is not only irregular but potentially unlawful.
“While the Prime Minister may have complied with the letter of the Federal Constitution, he has clearly violated its spirit,” Waytha declared. “No Prime Minister under active judicial scrutiny should hold sway over the very institution that might rule on his cases.”

The omission, Waytha argues, calls into question the very legitimacy of Anwar’s participation in judicial appointments.

Worse still, the process leading to Justice Wan Ahmad’s elevation is riddled with anomalies. Leaked minutes from the Judicial Appointments Commission (JAC), supported by a related police report, suggest that the Prime Minister’s Office may have exercised undue influence. Most notably, the promotion leapfrogged Wan Ahmad over 10 serving Federal Court judges and 22 more senior jurists, breaking with established Commonwealth conventions that prize seniority and impartiality.
“This is not merely a procedural irregularity,” Waytha said. “It is a dangerous precedent. When political loyalty overrides judicial merit, the very soul of our democracy is at stake.”

The statement also revealed that an earlier plan to fast-track Justice Terriyuddin to the top judicial post was dropped only after public uproar—indicating a pattern of calculated executive maneuvering, rather than transparent judicial governance.
